IRS 132 Executive Protection Studies

Independent security studies documenting that your executive protection program qualifies for tax-free treatment under Section 132(h).

If your company provides executive protection as a fringe benefit, the IRS requires proof it qualifies for tax-free treatment under Section 132(h).

That proof is a bona fide, independent security study — and it has to hold up if the position is ever examined. Noble prepares that study.

What the IRS requires

Section 132(h) only applies when two things are documented: a bona fide, business-oriented security concern specific to the executive, and a real security program — proportional to that concern, applied consistently, and in place around the clock. An independent study is what turns those requirements into evidence the IRS will accept.

What our study covers

Threat & Risk Assessment

A risk assessment specific to the executive, documenting a bona fide, business-oriented security concern.

Program Review

Independent review of the existing security program against the IRS standard: proportional coverage, in place around the clock.

IRS-Ready Documentation

Written findings and recommendations formatted for IRS review, plus follow-up showing the recommendations were consistently applied.

The report is written in the language the IRS looks for: a specific basis for concern regarding the executive’s safety, security proportional to that concern, and consistent application of the recommendations that follow. Vague or generic write-ups do not hold up under review — specificity does.

How it works

The process runs about six weeks and is remote-first. We gather the information we need, assess the existing security program against the IRS standard, and deliver a written study your company can rely on if the position is ever questioned.

Who this is for

Companies that provide executive protection as a benefit to a CEO or other senior executive, and need to substantiate that benefit’s tax treatment under Section 132(h). If protection is already in place, this study is what supports it.

Confidentiality

Executive security details are sensitive by nature. We handle every engagement discreetly, and we do not publish or reference client or executive names.
